Terms of Service

These terms govern your use of Guio, a mobile app and marketplace for audio tours created by local guides. By creating an account or using Guio, you agree to these terms. Read them. They are short.
Guio is operated by Basis Lda, registered in Portugal.
1. What Guio is
Guio is a marketplace. Independent local guides create audio tours and publish them in our app; travellers browse, buy and listen. Guio is not a tour operator and does not author tour content itself.
We curate and review submissions for quality and safety, but the guide remains the author of and responsible for the content of each tour.
2. Accounts
You must be at least 13 years old (or the minimum age for online services in your country) to create a Guio account. You are responsible for keeping your password (or SSO provider) secure and for activity on your account.
3. Buying tours
All purchases inside Guio are processed by Apple through the App Store as in-app purchases. Pricing, taxes and your right of withdrawal are governed by Apple's Media Services Terms.
Once you buy a tour, you have lifetime access on the account that purchased it, as long as the tour remains available in the store and your account is active.
4. Refunds
Refund requests are handled by Apple, not by Guio. To request a refund, go to reportaproblem.apple.com or open your purchase history in the App Store.
If Apple grants a refund, access to that tour is removed automatically. The amount previously credited to the guide for that sale is reversed accordingly.
5. Becoming a guide
Anyone with an account can apply to publish tours. When you submit a tour, you confirm that:
- You are the author of the content and own all rights to the audio, text and images, or have a licence to use them.
- The content is accurate to the best of your knowledge, lawful, and does not infringe anyone's rights.
- You are responsible for any tax obligations that arise from your earnings on Guio.
6. Revenue split
For each sale of your tour, the gross price is split as follows:
- Apple App Store commission: 15% under Apple's Small Business Program (subject to Apple's terms).
- Guio platform fee: 27% of the net (after Apple).
- You (the guide): approximately 58% of the gross sale.
Payouts are made monthly when accumulated earnings exceed €25. The first payout requires you to complete payment setup inside the app.
7. Editorial review and removal
Tours go through editorial review before they appear in the store. We may reject, request changes to, or remove any tour that:
- Contains inaccurate, misleading, defamatory or hateful content.
- Promotes illegal activity or unsafe behaviour.
- Infringes third-party intellectual property or privacy rights.
- Is consistently rated very poorly by buyers.
Removal does not affect the rights of buyers who had already purchased the tour, who keep access for personal use.
8. Acceptable use
You agree not to:
- Reverse-engineer the app or attempt to bypass paywalls.
- Republish, redistribute or resell tour audio or other content acquired through Guio.
- Use Guio to harass other users, spam, or transmit malware.
- Submit reviews you did not write or that you were paid to write.
9. Intellectual property
The Guio brand, app interface and code are owned by Basis Lda. Tour content is owned by the guide who created it. By publishing a tour, the guide grants Guio a non-exclusive, worldwide, royalty-free licence to host the tour, deliver it to buyers, and promote it in marketing materials related to Guio.
10. Disclaimers
Guio is provided "as is". We do not guarantee that the service will be uninterrupted, that GPS triggering will be accurate in every location, or that any specific tour will meet your expectations. Use common sense when walking — do not stare at your phone in traffic.
Guio is not responsible for the conduct of users outside of the app, including any in-person meeting between travellers and guides arranged independently.
11. Limitation of liability
To the maximum extent permitted by law, Basis Lda's total liability arising out of or in connection with your use of Guio will not exceed the amount you paid to Guio in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages.
Nothing in these terms limits liability for fraud, gross negligence, or anything else that cannot be limited or excluded by Portuguese law.
12. Termination
You can delete your account at any time (Settings → Delete Account). We can suspend or terminate accounts that breach these terms, with reasonable prior notice except in cases of serious or repeated breach.
13. Governing law
These terms are governed by the laws of Portugal. Disputes that cannot be resolved by discussion will be brought before the courts of Lisbon. If you are a consumer in another EU country, you also have the protection of the mandatory laws of your country and the right to use the European Commission's online dispute resolution platform.
14. Changes
If we update these terms, we will notify you in the app and by email at least 14 days before the change takes effect. If you do not agree with the change, you can delete your account before the new terms apply.
